He's confident Dearie will expedite the process and will be fair. He's suggesting a 4-week schedule. Dearie said up front that if Trump's lawyers don't want to say the documents are classified then the government's claim to classification will stand. Dearie continued that perhaps no one, including him, would even need to see them. At another point Dearie asked DOJ what if the 11th doesn't rule in their favor. DOJ responded: "We'll be looking at other appellate options," meaning the Supreme Corp.
The disturbing problem that is no matter what Dearie orders, it goes back to Cannon for her final order. Weissman said that if Dearie orders something for the DOJ then it would put a lot of political pressure on her to go along with it. But we've already seen that Cannon is a hack for Trump and the law is irrelevant to her. So we're going to have to rely on the Appeals Court or possibly the Supreme Corp on this.
