Popok on the narrow question in the Supreme Corp appeal

He focuses on this statement in the granted certiorari framing the issue:

"The petition is granted limited to the following question: whether and if so to what extent does a former President enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office."

He thinks that the Corp wants to make sure to distinguish official acts from those that are not. And also to distinguish whether official acts are immune during and after the presidency. He thinks of course official acts are immune during the presidency, but that the Corp will rule that they are not immune after the presidency. So even if as Trumpler claims his acts were official they are not immune after his tenure. And of course if those acts were not official as the DOJ contends then he is not immune.

Popok also thinks that addressing that narrow issue also will cut the time needed for the Corp to make their decision, which he thinks will be quick enough for the DOJ to still prosecute this case by August and complete it before the election. This is the first hopeful speculation I've seen on their accepting the appeal but it presumes too much. E.g. it presumes the Corp majority is acting objectively in good faith based on the law and we've seen that is not so much the case. While I hope he's right I still have serious doubts.
