He continues in this clip to show how the liberal Justices indicated that the majority went too far in deciding the ballot case as previously quoted. Tribe thinks the majority did the same thing in the immunity case. They could have just framed the issue specifically addressing whether the charges in the indictment constituted official acts, instead choosing to frame it more broadly as to what constitutes an official act. They did so to intentionally draw out the trial date, especially if they send it back the Chutkin to make such a broad determination thereby avoiding their own responsibility to make the requested specific determination.
Bottom line: The majority is ensuring the trial doesn't see the light of day before the election.
