The majority ruled to remove legal protective status for Haitian and Syrian immigrants. In doing so they sanitized out all of the Presidunce's comments by claiming that none of them were "overtly racial." Kagan's dissent included those that were obviously racist, proving once again the majority's own racism influences their decisions.
